  • Workers must serve at least 1 year with the employer to get qualified for gratuity.
  • Any worker must give notice before resigning. Understanding the resignation notice period is important for domestic workers who are planning to end their employment contract.
  • Termination of workers must not be for serious misconduct.
  • The domestic worker contract has been completed.
  • The employer terminated his worker without any legal issue

NOTE: If the worker has resigned without completing 1 year. They are not qualified for the gratuity as per the labor law.

Rule for Gratuity Calculation (as per Labor Law)

All the gratuity systems through which it works calculate the money based on basic salary and the number of years the worker has served their employer.

  • Less than 5 Years of Service
  • If the worker serves between 1 and 5 years, the gratuity income will be calculated as 21 working days per month of basic salary.
  • Gratuity = (Basic Salary ÷ 30) × 21 × Years Worked
  • Over 5 Years of Service
  • A loyal worker, who serves more than 5 years, has different criteria. Their working days will be calculated as 30 days with basic salary.
  • First 5 Years = (Basic Salary ÷ 30) × 21 × 5

Additional Years = (Basic Salary ÷ 30) × 30 × (Years – 5)

Total Gratuity = First 5 Years + Additional Years

Things can be cleared up well through an example.

Example 1:

  • Salary: AED 1,500
  • Service: 4 years
  • Calculation: (1,500 ÷ 30) × 21 × 4 = AED 4,200

Example 2:

  • Salary: AED 2,000
  • Service: 6 years
  • First 5 Years = (2,000 ÷ 30) × 21 × 5 = 7,000
  • 6th Year = (2,000 ÷ 30) × 30 × 1 = 2,000 Total Gratuity = AED 9,000

NOTE: The calculations done here are following UAE gratuity calculation law. So, they follow the MOHRE rules as well
